Scott Raves Travel Club – Terms and Conditions of Use

1. Introduction
   These Terms and Conditions (“Terms”) govern the use of the website located at srtc.com.au (“Website”), operated by Scotts Tickets Pty Ltd (ABN 12 345 678 901), an Australian private company limited by shares, with registered office at 2/290 Boundary Street, Spring Hill, QLD 4000. These Terms apply to all visitors, members, entrants, and participants who access the Website, subscribe to any of our membership offerings, participate in any trade promotion, competition, or giveaway (“Draw”), or engage in related services (including access to the Scott Raves Travel Club Telegram Alpha Group).

By accessing or using our Website, subscribing to our membership program, participating in our raffles or giveaways, or interacting with any content or services, you signify your acceptance of and agreement to be bound by these Terms, our Privacy Policy, and any additional terms disclosed at the point of engagement. If you do not agree to these Terms, please refrain from using our services.

2. Eligibility

2.1. The promotion is open to Australian residents only, aged 18 years or over.

2.2. Employees, contractors, affiliates, and immediate family members of Scotts Tickets Pty Ltd are ineligible to participate in the Draws.

2.3. You are required to update your account details if your residency status changes. Draws are strictly limited to Australian residents only, and failure to notify us of a change in residency may result in disqualification from the Draws.

3. Entry Mechanisms and Draw Participation

3.1. Eligible participants may receive entries into Draws through the following mechanisms:
(a) Subscription Members: Subscribers to an ongoing paid membership plan will automatically receive entries every 28 days based on their membership tier and subscription length. These entries accumulate with each billing cycle and remain valid for all future draws while the membership is active.
(b) One-off Packages: Individuals purchasing a one-time digital access package (which includes access to a limited learning community) will receive entries into the specific Draw identified at the point of purchase. These entries are valid only for that nominated Draw and will not carry over into any future or subsequent promotions.
(c) Bonus Entry Offers: At our discretion, we may offer additional entry methods including promotional opt-ins, referrals, or bonus campaigns.

3.2. All entries are automatically assigned upon confirmation of payment; no further action is required unless otherwise specified.

3.3. Entries are non-transferable and may not be sold, traded, duplicated via multiple accounts or assigned to any other party.

4. Entry Limits

There is no cap on the number of entries a participant may receive, provided they qualify through a valid membership or promotional offer. Multiple entries are permitted based on membership tier and duration.

5. Rolling Entries

Entries accumulated by ongoing subscribers do not expire and remain valid across all future draws as long as the member maintains an active subscription. If a member cancels, all accumulated entries are forfeited.

6. Prize Fulfilment and Winner Notification

6.1  Prize descriptions, including value (inclusive of GST), delivery timeframe, transferability restrictions, blackout dates (if any), and responsibility for incidental costs will be published for each Draw on the Website and in promotional material.

6.2  Winners will be contacted initially via phone call, with follow-up communication via email. If no response is received, we may contact the winner via social media messaging or public tagging. If a prize is not claimed within 14 days, or the winner is deemed ineligible, a redraw may occur as per permit requirements.

6.3  Winners consent to the Promoter using their name, suburb, likeness, and prize details for reasonable promotional purposes (without further compensation), unless they request anonymity.

7. Unclaimed Prizes

If a winner does not accept their prize within 14 calendar days, or fails to provide required verification, we will attempt contact up to three times (via phone, email, and social media if needed). If still unclaimed, we reserve the right to conduct a redraw or award the prize to a reserve winner.

8. Draw Method

8.1  Each Draw will be conducted using a random number generator, or other approved method as required by permit conditions.

8.2. The time, date, and location of each Draw will be published on the Website and in promotional material prior to Draw commencement.

9. Membership Terms

9.1. Subscriptions are billed every 28 days in AUD. Prices are inclusive of GST unless otherwise stated. You may cancel your subscription at any time via the ‘My Account’ page or by emailing support. Cancellation will take effect at the end of the current billing cycle.

9.2. Membership entitles users to: 

(a) Automatic entry into promotional draws, with entries increasing for each consecutive 28 of active subscription; and 

(b) Exclusive access to the Telegram Alpha Group, which provides travel-hacking strategies, frequent flyer guidance, and other curated insights

9.3. Subscription cancellations will take effect at the end of the current billing cycle. Upon cancellation taking effect, users will forfeit all accumulated entries  and access to services will be terminated (including removal from Alpha Groups) at the end of the billing cycle..

9.4. Downgrade offers may be presented upon cancellation, allowing members to retain their accumulated entries while reducing the number of future entries and access to Alpha Group content. These options are offered at the discretion of Scotts Tickets Pty Ltd.

9.5. Additional membership tiers, including upgrade options, may be introduced in the future. Upgrades will allow users to retain all accumulated entries and gain access to enhanced features.

9.6. The Founding Member Tier is a limited release offering early access and perks during the platform’s initial rollout period. It may be modified, capped, or closed to new signups at the business’s discretion.

9.7. All fees paid for the current billing cycle are non-refundable, and you will not be entitled to a pro-rata or partial refund for any unused portion of your subscription, except as required by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement. 

9.8. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL or any other applicable law that cannot be excluded, restricted or modified by agreement.

9.9. We reserve the right to suspend the Website for maintenance and will use reasonable endeavours to restore service promptly.

10. Use of Telegram Alpha Group

10.1. The Telegram Alpha Group is an invite-only chat group curated by Scotts Tickets Pty Ltd. This group provides educational discussion and peer-to-peer guidance around travel rewards, mileage programs, flight redemptions, and deal stacking.

10.2. The content shared in the group is for informational purposes only and should not be construed as professional financial, credit, tax, or legal advice.

10.3. Access to the Alpha Group may be modified, paused, or terminated at any time.

11. Data Collection and Privacy

11.1. By opting in to our Website, you consent to the collection of personal data including name, email, phone number, IP address, browser data, and any information voluntarily provided during entry, subscription, or survey activity.

11.2. We use Meta Pixel, TikTok Pixel, cookies and may incorporate additional tracking technologies in future.

11.3. Collected data is used for: (a) User account maintenance (b) Email and SMS marketing (c) Entry management (d) Performance analytics and advertising optimization (e) Additional business activities that may arise in connection with the operation, marketing, or administration of our services.

11.4. Your data may be shared with third-party service providers and across our affiliated businesses for the above purposes. Your personal information may be transferred to servers located in the United States and the European Union for data storage and processing. We take reasonable steps to ensure that any overseas recipient complies with the Australian Privacy Principles (APPs) or is subject to a law that affords substantially similar protection.

11.5. Personal information is handled in accordance with the Privacy Act 1988 (Cth) and the APPs; see our full Privacy Policy srtc.com.au.

11.6. You may request deletion, opt out of marketing, or access your data by contacting us at scottravestravelclub@gmail.com.

12. Platforms and Promotion

We promote and manage our Draws and related services via Facebook, Instagram, TikTok, email, SMS marketing, and other digital platforms. By entering a Draw or subscribing, participants consent to receiving communications through these and any future platforms used by the business.

13. Permit Exclusions

Draws will not be open to residents of any Australian state or territory where permits are not held or required. Geographic exclusions will be disclosed in promotional material if applicable.

14. Refunds, Modifications & Terminations

14.1. All membership and entry purchases are final and non-refundable for the current billing cycle, except as required under the ACL or other applicable law. 

14.2. We reserve the right to change pricing, membership structures, entry mechanisms, or platform functionality with reasonable notice.

14.3. We may suspend or terminate any account for abuse, fraud, misconduct, or breach of these Terms. This includes but is not limited to manipulating entry systems, providing false information, or engaging in behaviour deemed inappropriate or damaging to the community.

14.4. If we make material changes to your membership that substantially disadvantage you (such as a significant price increase or substantial reduction in core features), you will be given reasonable notice via the Website. These changes will not be implemented during a current billing cycle.

15. Intellectual Property & UGC

15.1. All Website content, promotional graphics, and group materials are owned by Scotts Tickets Pty Ltd or its licensors.

15.2. Users may not redistribute any private group content, Telegram discussions, or insider tools without written consent. Unauthorised use of our intellectual property is prohibited.

15.3. By tagging, submitting, or referencing our brand, you grant us a perpetual, royalty-free right to reuse that content in marketing.

15.4. If you believe your copyright has been infringed by user-generated content on our platforms, please contact us for prompt takedown under our DMCA-style procedure at: scottravestravelclub@gmail.com.

16. Tax Obligations

All subscribers and prize winners are solely responsible for any tax implications, declarations, or financial consequences arising from their winnings or participation. Participants should seek independent tax advice if required.

17. Legal & Jurisdictional Terms

17.1. These Terms are governed by the laws of New South Wales, Australia.

17.2. Scotts Tickets Pty Ltd is not liable for any incidental, indirect, or consequential damages related to the use or performance of our services, except as required under the Australian Consumer Law.

17.3. Subject to any rights you may have under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified, Scotts Tickets Pty Ltd’s maximum aggregate liability to you for any loss or damage arising out of or in connection with your use of the Website or services is limited to the total amount paid by you to us in the 12 months preceding the event giving rise to the liability.

18. Force Majeure

We shall not be liable for delays or failures in performance due to causes beyond our control, including but not limited to natural disasters, government restrictions, pandemics, internet outages, third-party software disruptions, labour strikes, or other events deemed “Acts of God.”

19. Entire Agreement

These Terms and Conditions constitute the entire agreement between the user and Scotts Tickets Pty Ltd, superseding all prior communications, representations, or agreements.

20. Severability

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

21. Waiver

Any failure to enforce a provision of these Terms does not constitute a waiver of that provision or of the right to enforce it in future.
